The National Student Financial Aid Scheme (NSFAS) has urged landlords never to require a deposit or top-up payment from NSFAS-funded students.

This comes right after NSFAS received experiences about some accommodation providers who need NSFAS-funded students to pay a deposit or top-up payment in order to get access to the accepted private accommodation.

"NSFAS reminds accommodation providers on the compulsory conditions, as provided by the Standardised Fixed-Term Lease Agreement among the private accommodation companies and NSFAS funded students," NSFAS stated in a statement on Thursday.

The Standardised Fixed-Term Lease Agreement states which the lease is going to be paid month-to-month to the accommodation company (lessor) by NSFAS, on behalf of the lessee (NSFAS funded student), in accordance using the NSFAS terms and conditions for personal accommodation companies’ participation on the student accommodation portal.

"The lessor may not involve or allow the lessee to pay for a deposit, top-up payments, or almost every other types of payment into the lessor, or some other person in reference to this agreement, together with payment of rent, even though awaiting payment from NSFAS. The lessor shall have no recourse website in opposition to the lessee for any default during the payment of rent by NSFAS," the agreement reads.

The NSFAS terms and conditions for private accommodation vendors’ participation on the student accommodation nsfas academic pathways portal also states that: "Where the NSFAS-funded student is defunded on account of an incorrect determination by NSFAS, the student will not be accountable for check here payment of any arrear rent into the accommodation supplier, up right up until the date of being defunded."

The scheme emphasised that any dispute arising between the parties regarding the interpretation or implementation of the agreement, must be dealt with in accordance with any dispute resolution procedure determined by NSFAS for this purpose.
